CATCHING THE 5 VILLAGERS OF BATU DAYA, SIMPANG DUA SUB-DISTRICT, 
KETAPANG DISTRICT, WEST KALIMANTAN.

Exampt the villagers of Batu Daya, terminate the chief of the West Kalimantan Police and give back the land to the Indigenous communities that have been grab by PT. Swadaya Mukti Prakarsa.

May 5, 2014, At 06.00 pm Monday. villagers of Batu Daya, Simpang Dua subdistrict, Ketapang District of West Kalimantan Province was shocked by a group of police, brimob and the company PT. Swadaya Mukti Prakarsa (SMP).

When Antonyius Situ and Libertus drive the motorcycle, on the way to work in PT. SMP / FR, In 28 Km, the part of Batu Daya Village suddenly a group police stop and gun point to them, and than arrest Antonius Situ with his hand was handcuffed. The Police bring Antonius by Dalmas car, while Libertus managed to escape in to the forest.

After arresting Anthony sintu, the group of mobile brigade (Brimor) proceeded enter to the Batu Daya village to the Mr. Anyun’s house, immediately arrested and handcuffed him without showing an arrest warrant. And then, the group of police divided into two teams, one team going to the Mr. Bethlyawan’s house (Head village of Batu Daya), while the other team going to the Mr. John Singkul’s house (Chairman of BPD) .

The head village’s wife, Leni Marliyana try to ask the group of Brimob that come to their house about the Brimob intentions, but one of the Brimob gun point to her. After, Mr Bethlyawan see the incident, he reacted and stated “if you want to arrest me and my wife, please arrest also our son because no body will take care of”. Finally, the Brimob just arrest Mr. Bethlyawan and let his wife and son.

Meanwhile, another group of Brimob was in Mr. John Singkul’s house, surrounded the house and put a gun to Jidin (25) who works as a home pack in Singkul John’s house, a cop questioned to him whether the truth of the house belonging to Mr. John, because he is afraid and do not understand Jidin not answer.

And then The group of Police entered in the house by broke down the door of the house, 8 police go in through front door and then broke three bedroom door; Teten’s room, who was lying because of fever, next is Mr. Rudi’s room (John Singkul’s brother in law) was also sick (Stroke), and the last was Saputra’s room (John Singkul’s son in law).

While four policemen entered through the back door and met with Ms. Dandang (Mr. John Singkul’s wife) who was cooking. Then the police ask her “where is Mr. John Singkul”, because the police does not get direct answers, they ransacked and find Mr. John Singkul in toilets and directly attacking and arrest, the person holding the neck, the two police hit the left and right foot, and also hit Mr. John singkul’s head, so he fell down and immediately dragged, his wife saw the incident and then she said" he is not an animal, why you do that" a policeman threatening her after got the question" just silence it will well taken care of" Ms. Dandang then replied "if taken care well why did you continue beaten and not picked up nicely, do not be dragged like that"

The arrest incident, looked by some mother and the childre, Mr. Yohanes neighboars. By saw a lot of people looked the incident, one of the Brimob held a weapon while saying "You do not intervene, quickly entered to your house". Viewing events that accompanied the arrests and beatings of force, Mr. Puram Jorben Marinel (30) is a “limnas” Batu Daya village (neighbor Mr. John Singkul) conduct a defense of arrests that occurred and then attraction towards Mr. John and asked the police not to commit acts of violence. After got protests from the Mr. Jorben, 6 police surrounded and one hit Mr. Jorben’s face and then arrested and brought to the West Kalimantan Police office.

On the way to Pontianak, the group of brimob that brought 5 villagers of Batu Daya village stop in crossroads, when they stopped the group man; the management of PT. SMP namely Mr. Hidayat Nasution (manager coordinator), Mr. Tri Brata (general askep) and the two guards,  approached to the brimob, then they communicate but not body from (5 villagers that arrested) what they discuss about, and after that the brimob continue the trip .

Around the area of  the “simpang ampar” the group stop for lunch, before take lunch and take a rest, one police ask to the 5 villagers" who the perpetrator throwing stones against police during the incident at Camp Company PT. SMP on October 26, 2013?" the 5 villagers who arrested did not answer, then the police ask again "who is named Mr. Anyun?" then one answer and raising hand "me sir" then immediately, the police hit Mr. Anyun’s face by his hand, the other police that saw the incident reminded not to do it again.

After arriving in West Kalimantan regional police office at 15.00 am, 5 people arrested brought to the regional police investigator room and taking picture by the police, and then they interviewed by thepolice

The next day, May 6, five villagers that arrested are asked to sign an arrest warrant with the date May 5, 2014. Then 3 people freed, they are Mr. Antoniyus sintu, Mr. Bethlyawan and Mr. Marinel jorben Puram, while the 2 people, they are Mr. Anyun and Mr. John Singkul on hold.

From the above kornologis show us that arrested that committed by the police and Brimob to the villagers Batu Daya village, Simpang Dua subdistricts Ketapang districts, West Kalimantan Province impressed in force and trample applicable law (according to article 17 of the Criminal Procedure Code and explanation).

By the arrested incident that inhumane acts, Alliance of Agrarian Reform Movement demands expressed as follows:

1. Exempt the five farmers from Batu Daya Village, Simpang Dua subdistrict, Ketapang district of West Kalimantan province that has been arrested by police units and brimob west Kalimantan regional Police by inhumane.
2. We ask to the police chief to removed and judge the chif of West Kalimantan Police region, as the person who responsible for the inhuman arrests of five villagers of Batu Daya village, Simpang Dua subdistricts Ketapang districts, West Kalimantan Province.
3. Give back the land to the villagers Batu Daya that suspected grab by PT. Swadaya Mukti Prakarsa.
4. Stop the criminalization of the peasants throughout Indonesia are demanding their land rights in return.
5. Implement Genuine Agrarian Reform

Herewith we also call upon all the peasants :

1. Strengthening peasant unity by forming a national democratic mass organization.
2. Promote the struggle for the implementation of genuine agrarian reform.
3. For all parties to support the struggle of the peasants in the Batu Daya village in terms of maintaining their land rights .
