National human right commission will guard the supreme court verdict about the cancellation of the right of cultivate (HGU)

About 15 peoples from Kubu Raya Farmer Union representative (STKR), chief village and district representative committee from 6 villages in Kubu sub-district, Kubu Raya district, west Kalimantan province visited national human right commission accompanied by AGRA as the main national organization STKR, as well as NGO such as WALHI, Sawit Watch. They arrived around 12 noon and was welcomed by Mrs. Siane Indriani, vice president of national human right commission, external field.

The arrival of the community representative was associated with the conflict against plantation limited liability compuny Sintang Raya, where as per today those plantation company still operated, eventhough administrative court has canceled their permit according to the community's lawsuit, even the supreme court has decided that the lawsuit was won by the community.

limited liability compuny Sintang Raya itself was build according to the establishment certificate no. 26, March 22nd, 2002 by notary, Hobby Simanungkalit, S.H. at Sintang and approved by minister of law and human rights no AHU-14600.AH.01.01, 2008, on March 26th, 2008. But before having legal entity, limited liability compuny Sintang Raya have been doing operational with a couple of activities such as arrangement of principle permit from district council : no. 503/0587/I-Bappeda, on April 24th, 2003, arranging location permit: no. 400/02-IL/2004, on March 24th, 2004, accomplish plantation permit: No. 03/0457/II-Bappeda, on April 1st, 2004 and renew location permit: No. 25, 2007, on January 22nd, 2007, this is against the rules of company limited.

limited liability compuny Sintang Raya possessed right to cultivate (HGU) as far as 11.129,9 Ha, that was published on 2009, on the community land and transmigration land, limited liability compuny Sintang Raya is a joint venture of the capitalist from 4 companies, 3 of them were companies with the private capital, (95%), that consist of limited liability compuny Miwon Agrokencana Sakti (combined of state, 53,45%), Daesang Holdings Co.Ltd (South Korea, 23,28%), and Eagle Word Development Corp (British Virgin Islands, 18,27%) and Kentjana Widjaja (Indonesia, 5,00%).

Vice president external field, national human right commission, stated that the community struggle has very advanced until there's a verdict from the supreme court, because there are many complaint that national human right commission has received generally still at the early stage of the conflict and abuse, but this case has been very good in struggle. The community have been able to fight until got the supreme court verdict. The more conflict problem that happened in Indonesia, Siane (vice president of external field, national human right commission) felt very sorry and sad about government policy that makes the infestation come first than community welfare.#
